Equity and Trusts (M3067)
30 credits, Level 6
Autumn and spring teaching
This module will explore the development of equitable rules, principles and case law relevant to the modern law of trusts.
With a focus on the certainties, formalities and the constitution of trusts, you will consider how trusts are created and enforced. A closer look at the duties and responsibilities of trustees and fiduciaries will lead to the study of some of the processes and remedies available to a beneficiary where trust property has been misappropriated.
You will also look at express and implied trusts in relation to the family home, private purpose trusts and charitable trusts that operate for the public benefit.
